General Terms and Conditions for the online business of Knauf Jewels GmbH (online shop - GTC) - Effective January 2019 -
- General Information / Scope
These Terms and Conditions apply to the sale and delivery of the products presented on the website www.knauf-jewels.com By ordering our products, you agree to the following conditions.
- Order Placement and Formation of Contract
Ordering a product on the website www.knauf-jewels.com, after clicking the button “Buy now” is a binding offer to purchase the product in agreement with these Terms and Conditions. Orders are subject to acceptance by Knauf-Jewels. We reserve the right to either accept your order within 14 days from receipt or to reject it explaining our decision. The binding contract of sale for the products you have ordered only is affected when we accept your order. You can consider your order accepted when we email an explicit confirmation of the order.
- Pricing and Terms of Payment
The price of the product is stated in the respective information provided on the website. The prices indicated include the statutory value-added tax, but do not include shipping costs, which you can find next to the offers. Before placing your order, the website will show the unit price including shipping costs and also the total amount. You can pay by credit card, remittance, or PayPal. For credit card payment, you can use one of the credit cards specified in the checkout process by providing your card details on the website. We will therefore charge the total amount due to the credit card you specified when placing the order on the day we ship the products.
- Delivery / Transfer of Ownership and Risk
If the ordered products are in stock, a delivery service we hired will deliver them to the address stated in your order and in our order confirmation within ten days after the contract has been concluded. If the products have to be manufactured first, delivery will take place after six weeks. You will not receive ownership of the delivered products until you have settled the full purchase price. We may withhold the products until full payment has been made and the revocation period has expired.
- Notification Regarding Revocation (Widerrufsbelehrung)
If you are a consumer as defined in Section 13 of the German Civil Code ( §13 Bürgerliches Gesetzbuch – BGB), meaning that you are acting as a natural person who is making a purchase from www.knauf-jewels.com for purposes that are predominantly outside your trade, business, or profession, you have the following right of revocation:
- Warranty
The statutory warranty rights apply to all goods in our online shop.
- Liability
Knauf-Jewels GmbH is liable for damages under statutory warranty and other legal grounds, in particular for tort, organizational negligence, fault in concluding the contract or other breaches of duty, only in the event of intent or gross negligence by Knauf-Jewels, its legal representatives, or vicarious agents. The above limitation of liability for cases of minor negligence does not apply to damage arising from injury to life, limb, or health or from a breach of essential contractual obligations. In such events, Knauf-Jewels GmbH is also liable for minor negligence on the part of its legal representatives or vicarious agents.
- Other: Restrictions on Transferability, Place of Jurisdiction, Settlement of Disputes
The claim to delivery of ordered products may only be transferred to third parties with our prior written authorization.
The UN Sales Convention (CISG) does not apply.
In commercial transactions with merchants, Wiesbaden, Germany, is the agreed place of jurisdiction for all disputes arising from these Terms and Conditions. Knauf Jewels GmbH is entitled to sue at the customer’s place of business as well.
For disputes arising from contracts concluded by consumers of an EU member country with us via the Internet, please refer to the online dispute resolution service (“ODR service”). You can find this service under the following link:

Knauf Jewels GmbH also engages in consumer dispute resolution under the Act on Alternative Dispute Resolution in Consumer Matters.
Should any provision of these Terms and Conditions be or become invalid or impracticable, it will not affect the validity of the remaining provisions.
